You must not access or use our Platform if you do not agree to these Terms. “Company”, “we”, “us” or “our” refers to ForestMap.AI and its affiliates, officers, directors, and employees. “User”, “you” or “client” refers to the individual or entity accessing the Platform. “Content” refers to text, data, and other materials accessed through the Platform. These Terms apply to your use of the Platform (website, contact forms, emails) and do not govern any consulting or software development services provided under separate written agreement.
These Terms and Conditions, together with your use of the Services, are governed by and interpreted according to English law, without giving effect to its rules regarding conflicts of laws. The courts of England and Wales shall have exclusive jurisdiction.
Use of Services
What you can do:
We grant you a limited, non-exclusive, revocable right to browse the Platform and view the Content solely for your personal or internal business information purposes (e.g., to evaluate our services). Commercial use of our professional services requires a separate written agreement.In using our Platform, you must comply with all applicable laws as well as our Privacy Policy and any other documentation, guidelines, or policies we make available to you.
Third-Party Use and End Users : If you access the Platform on behalf of an entity or to provide output to third parties ("End Users"), you represent and warrant that: * You have obtained all necessary permissions and valid consents from your End Users to share their data, specifically informing them that ForestMap AI may process their data to facilitate the Platform's functionality; * You are solely responsible for protecting the privacy and legal rights of your End Users; and
You will ensure that your End Users comply with the acceptable use rules set forth in these Terms. You accept liability for any breach of these Terms by your End Users.
What you cannot do:
In using this Platform you agree that you will not do any of the following:
Post, submit, or otherwise distribute any materials that:
Are threatening, harassing, degrading, hateful, intimidating, obscene, indecent, or otherwise objectionable;
Contain potentially harmful or invasive items, including viruses, worms, trojan horses, time bombs, corrupted files, hoaxes, spyware, or any other computer code, file, or program of a destructive or deceptive nature;
Infringes, misappropriates, or otherwise violates any third party’s intellectual property, privacy, publicity, or other legal rights, or is shared without necessary permissions or consents;
Are defamatory, fraudulent, or violate any applicable law or regulation.
Disable, interfere with or disrupt the operation of the Platform, including by hacking or defacing any portion of any of the Platforms or interfering with anyone's appropriate use of the Platform.
Claim or imply that you are affiliated with or endorsed by ForestMap AI, unless given explicit prior permission
Copy, modify, create derivative works of, sell, distribute, or otherwise exploit any part of the Platform or present any part of the Platform as your own, except where such activity is expressly permitted by applicable law.
Intellectual Property
ForestMap AI owns all intellectual property (IP) rights in our Content. Our IP rights are those that are created and protected by copyright, trademark, and other applicable intellectual property and unfair competition laws.
Data Security and Privacy
By using the Platform provided by ForestMap AI, you acknowledge and agree to the terms of our Privacy Policy as outlined on our Platform
Disclaimers/Limited Liability
You are responsible for maintaining your own data backups. ForestMap AI is not liable for any loss, deletion, or failure to store data or communications processed through the Platform.
To the maximum extent permitted by law, ForestMap AI shall not be liable for any indirect, incidental, special, consequential, or economic losses arising out of or relating to your breach of these Terms, misuse of the Platform, or violation of applicable law.
Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
We are not responsible for or do not endorse content, products, or transactions on any third-party websites we link to.
Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless ForestMap AI against any claims, losses, liabilities, and reasonable costs (including legal fees) arising out of or relating to your breach of these Terms, misuse of the Platform, or violation of applicable law.
Termination
We may suspend or terminate your access to the Platform at any time if you breach these Terms or violate applicable law. You may stop using the Platform at any time.
Miscellaneous
Your use of the Platform does not create any partnership, employment, agency, or similar legal relationship between you and us
We reserve the right to modify these Terms and Conditions at any time. Updated versions will be posted on our Platform. You should check this document online for the latest information and ensure you are happy with any changes.
If any provision of these Terms is deemed invalid or unenforceable, it shall not impede the validity of the remaining terms. A failure or delay in enforcing any term shall not be deemed a waiver of that term or any other term
These Terms govern the Platform and pre-contract communications only. Any consulting work is governed solely by a separate written agreement.
